NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN, NOR WILL A PURCHASE IMPROVE ONE'S CHANCES OF WINNING
1. SPONSOR: Buena Vista Magazines, Inc., dba FamilyFun Magazine, 114 Fifth Ave., New York, NY 10011, is solely responsible for all aspects of this contest ("Contest").
2. ENTRY: During the period beginning at 12:01 A.M. Eastern Time, September 16, 2008 and ending at 11:59:59 P.M. ET, November 30, 2008 ("Entry Period"), you may enter this Contest via the Internet at familyfun.com/volunteers ("Website"). The qualifications to participate in this Contest require a contestant family of not less than two (2) persons, at least one of whom is younger than 15 and one 18 or older ("Family"). The subject of this Contest is any volunteer work project with an environmentally friendly goal performed by a Family as a team ("Project"). At the Website, you will be asked to supply your name, address, telephone number, and e-mail address ("Address"), which will be used only for the purposes of contacting you for this Contest. You will then be asked to answer a series of 7 short questions: (1) What was the volunteering Project? Please be specific when naming the organizations helped. (2) Which members of your family volunteered together? Please give names, ages, and family relationships (i.e. John, 36, father and James, 6, son) and be specific about which members of the family did what work on the project. (3) How often and when did you volunteer? (i.e. "twice a month in July and August or "three hours on the first Saturday of every month"). (4) Approximately how many hours per person in 2008 were spent volunteering on this particular Project? Please individually list each person and their total volunteer hours. Then submit your answers (not to exceed two thousand (2,000) characters for each answer) to each of the following questions: (5) What was special about the way you volunteered together as a family? (6) How did your volunteer work benefit and/or improve the environment? (7) How did your volunteer work together strengthen your family? Contestants must respond to all 7 questions plus supply all contact information in order to enter the Contest (collectively, "Entry").
3. LIMITATIONS: Each Entry must be received by November 30, 2008. Only one Entry per Family. Entries must be the original work of the Family, must not infringe upon third party rights, nor can the work project previously have won awards nor been widely publicized. Open only to Families composed of persons who are legal residents of, and physically located within, the 50 states, D.C. or Canada (excluding Quebec) ("Territory"). Employees of Sponsor and theHandsOn Network; their respective parent, subsidiary, and affiliated companies; the advertising, promotional, and fulfillment agencies of each of them; (individually and collectively, "Entities"), members of their immediate families and members of their households are all ineligible. Neither the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, "Releasees") are responsible for Entries from Families residing, or physically located, outside the Territory; Entries that are altered, delayed, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misdirected, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Rules; or for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software, or telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable e-mails resulting from any form of active or passive e-mail filtering; insufficient space in entrant's e-mail account to receive e-mail; or other errors of any kind, whether due to electronic, human, mechanical, printing, production or technical errors or other causes; even if caused by the negligence of any of the Releasees. Each of such potential Entries will be disqualified; and any attempt by a Family to use multiple e-mail accounts to register more than once may result in disqualification at Sponsor's sole discretion. Void where prohibited or restricted by law and subject to all federal, state, provincial and local laws and regulations.
4. PRIZES: Five (5) Grand Prizes: One (1) donation of $5,000 by the Sponsor to the winning Family's favorite 501 (c) 3 charitable organization or public school ("Charity"). Recognition Prizes: One (1) FamilyFun Volunteer's certificate (ARV: $0) to each Family participating in the Contest. Total value of all donations to Charities: $25,000. Prizes are not transferable. No substitutions allowed except, at Sponsor's sole discretion, a prize of equal or greater value may be substituted. All prizes will be awarded provided a sufficient number of eligible Entries are received and prizes validly claimed by February 1, 2009.
5. PROCEDURES: Entries will only be accepted during the Entry Period. On or before December 28, 2008, all eligible Entries will be judged by Sponsor and the HandsOn Network, who will select the potential winners on the basis of creativity and positive impact on the environment, community and Family.
6. WINNERS: The potential winners will be notified by mail on or about December 30, 2008, and the winners announced in the April 2009 issue of FamilyFun Magazine. All legal responsibilities of a Family under these Official Rules ("Rules") will be assumed by the Family's parent/legal guardian. At the sole discretion of the Sponsor, disqualification, forfeiture, and the selection of an alternate winner may result from any of the following: [1] potential winner's failure to respond to notification within ten (10) days after its mailing; [2] the return of any notice or donation as undeliverable; [3] potential winner's failure to provide Sponsor with satisfactory proof of ages, identity and residency; [4] potential winner's failure to execute and return an Affidavit of Eligibility/Liability/Publicity Release within ten (10) days after it is mailed; [5] potential winner's Charity's failure to claim a prize within ten (10) days after it is sent; [6] potential winner's failure to validly claim any prize before February 1, 2009; [7] potential winner's failure to designate a proper Charity and [8] any other noncompliance with Rules. In the event of a prize forfeiture, the Sponsor may, in its sole discretion, award or not award the forfeited prize to an alternate winner. All taxes, if any, are solely the winner's responsibility.
7. CONDITIONS: By entering this Contest on behalf of the Family, you agree, represent and warrant that: [1] you will be bound by the Rules and the Sponsor's decisions, which shall be final in all respects; [2] you irrevocably assign and transfer to Sponsor and its assigns all rights in the Entry, including, without limitation, all copyrights; [3] the Entry will not be acknowledged or returned; [4] you grant to the Sponsor and its assigns the right to publish, use, adapt, edit, and/or modify such Entry in any way and in any and all media, without limitation, and without consideration or acknowledgment to you; [5] you release and hold harmless the Releasees from any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize or participation in the Contest or any Contest-related activity or travel, or from any interaction with, or downloading of, computer Contest information; [6] the Releasees do not make any representation, warranty, or guarantee, express or implied, relating to the Contest or prizes; [7] your acceptance of a prize constitutes the grant to Sponsor and assigns of an unconditional right to use your Family members' names, addresses (city and state or province only), voices, likenesses, photographs, biographical, and prize information and/or statements about the promotion for any publicity, advertising, and promotional purposes without additional compensation, except where prohibited by law; [8] in the event unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor's reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of this Contest, so that it cannot be conducted as originally planned, Sponsor has the right, in its sole discretion, to modify the Rules or to cancel, modify, terminate or suspend the Contest; and in such event, to select winners by such method as Sponsor in its sole discretion shall consider equitable; [9] the Releasees are not responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to: errors in the advertising, Rules, selection and announcement of the winners and distribution of the prizes; [10] any portion of any prize not accepted by a Charity will be forfeited; [11] the Releasees are not responsible for any inability of any Charity to accept or use any prize (or any portion thereof) for any reason; [12] the Sponsor has the right, at any time and at its sole discretion, to disqualify any individual it suspects to be doing any of the following: (a) tampering or attempting to tamper with the entry process or the operation of the Contest; (b) violating the Rules; (c) violating any other terms, conditions of use, and/or general rules or guidelines of any Contest property or service or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; or for any other good cause as determined solely by the Sponsor and [13] Sponsor has the right to modify prize award procedures at its sole discretion.
